We find the breach proved.

He is fined the sum of $150 and is reminded of his professional obligations. 

Charge:

Mr Davidson alleged that Mr Doherty, rider of DENISE’S TOY BOY struck his mount excessively prior to the 200 metres. 

Facts:

Mr Zarb, stipendiary steward, demonstrated on the video that the respondent used his whip some 10 times before the 200 metre mark. 

Submissions for Decision:

Mr Zarb said while Mr Doherty had made some effort to break up the strikes he had not grabbed the rein and there were simply too many strikes in that period. 

Mr Doherty said he had been asked to give the horse a hard ride. He said he had finished 3rd and had coaxed the best that he could out of the horse. Mr Hutton, assisting Mr Doherty, said had the horse failed to show anything today it was likely that it would have gone back into the paddock. 

Reasons for Decision:

Mr Doherty admitted the breach. 

Submissions for Penalty:

Mr Davidson produced the respondent’s record, which was clear under this rule this season. He submitted a fine in the range of $100 to $200 was appropriate. Neither Mr Hutton nor Mr Doherty wished to comment. 

Reasons for Penalty:

We agree there are approximately 10 strikes before the 200 metres in circumstances which are clearly outside the whip guidelines.

Mr Doherty has admitted the breach and his record is clear under this rule this season.
