Facts:

 Mr Ray had Mr Allison, stipendiary steward, demonstrate on the video that Mr Doherty struck his horse 10 times with full use of he whip and a couple of further taps some 100 to 150 metres prior to the 200 metre mark. 

Submissions for Penalty:

Mr Ray said the defendant had no breaches of the rule for 3 seasons, nor had he been spoken to in that time. He submitted a penalty of around $150 was appropriate.
Mr Doherty did not wish to be present and had left the course by the time the hearing was held.

Reasons for Penalty:

Mr Doherty has admitted the breach and has an excellent record. We believe the matter can be dealt with by way of a fine at the lower end.
