Under Rule 871 (1) (d) Mr Ching, stipendiary steward, alleged that with approximately 800 metres to run in race 7 at Wingatui on Thursday 17 May, Mr Moseley riding RUBY'S GEM allowed his mount to shift inwards,
Under Rule 871 (1) (d) Mr Ching, stipendiary steward, alleged that with approximately 800 metres to run in race 7 at Wingatui on Thursday 17 May, Mr Moseley riding RUBY'S GEM allowed his mount to shift inwards, causing tightening to OUR LOUISE (Mr S Fieldes) who in turn checked OF THE ESSENCE (Mr J Misbah).
--Mr Ching stated that he considered that Mr Moseley had shifted from a position 3 wide to 2 wide in the incident. He said Mr Moseley had rolled in slightly. He demonstrated on the side-on video that for a distance of some 50 metres or so OF THE ESSENCE was racing about ? a length back on the inside of OUR LOUISE. He showed OUR LOUISE had its head turned away, which he said was as a consequence of pressure from its outside. Mr Ching used video footage in support of his allegation and called apprentice jockey, Mr S Fieldes to give evidence.
--Mr Fieldes stated that there was a little bit of pressure from his outside for several strides leading into the bend, but that he didn't call out. He stated that he had tried to come out to make room for Mr Misbah who was ? a length back. He said Mr Misbah had called out to give him room. Mr Fieldes stated that he "didn?t feel there was room there" for Mr Misbah to improve on his inner. There was contact between the horses.
--In his defence Mr Moseley stated that he failed to see from the video evidence where his horse had moved in. He admitted he was not aware Mr Misbah was on Mr Fieldes' inner, but pointed to Mr Fieldes' evidence that Mr Misbah should not have attempted to improve along the inner. Mr Moseley also asserted that any movement of his mount was slight, and did not constitute careless riding. When asked by the Committee whether he thought there was room for Mr Misbah to improve on the inner, Mr Moseley responded "I would not have put myself there".
--In response to another point raised by the Committee ? the apparent outwards bulge of the running rail just prior to the turn ? Mr Moseley stated that he considered it was a factor in the tightening that had occurred, and noted that he had previously raised this issue with Mr Ching. Mr Moseley stated that he had previously been on the receiving end of tightening at this location, but had never considered this to have been the fault of any rider. Mr Ching confirmed that Mr Moseley had raised his concerns with the bend previously. Mr Ching also conceded that it was a difficult corner.
--In summing up, Mr Ching stated in his view Mr Misbah was entitled to be "in there" and was entitled to his own racing line
--DECISION:
--We indicated on the day that the charge was dismissed and that our written decision would be posted on the JCA website as soon as possible.
--Having listened to all the evidence and repeatedly viewed the video evidence available, we have come to the conclusion that OF THE ESSENCE was checked due to 3 factors: the limited room available to Mr Misbah as he attempted to improve on the inner of OUR LOUISE, (at no time had he progressed past the girth of that horse); general tightening as the field approached the bend; and the alignment of the running rail.
--We consider that any inwards movement by Mr Moseley was slight and not clearly a significant factor in the interference suffered by OF THE ESSENCE.
--We therefore dismiss the charge.
--In light of the acknowledgement by both parties that there is an issue with the running rail at this point of the track, we request that this matter be drawn to the attention of the Club.
