Mr Bourke admitted the charge, it was found proved.

Penalty:

We adopt the South Island starting point of three days suspension. We do not increase the starting point, despite the interference to two horses through the respondent’s carelessness. In this regard we note the racing manners of Sulcifera, which were clearly erratic and a major contributing factor to the incident. Given that Mr Bourke is an apprentice jockey and his guilty plea, we reduce the penalty to two days’ suspension.

Mr Bourke is suspended for two south island riding days from the conclusion of racing today up to and including September 29. Riccarton 23rd September and Gore 29th September (2 SI days).

Facts:

Following the running of r#6 the NZB Insurance Pearl Series 1200m the stewards lodged an information alleging Apprentice Jockey G Bourke breached rule 638 (1) (d) – careless riding- in that he “…permitted his mount Sulcifera to shift inwards when not sufficiently clear of Mamma Sans which was checked near the 1100 metres going back onto Saronic Miss.”

Rule 638 (1) (d) reads:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be

(d) careless.

Mr Bourke admitted the charge and appeared at the hearing. He was assisted by Mr D Walsh.

Mr Oatham, with the use of video replays, showed where Sulcifera was drawn on the extreme outside at barrier 14. Mamma Sans was drawn about midfield on his inside. Soon after the field jumped Mr Bourke attempted to shift ground inwards but in doing so got onto the heels of Funny Face. He restrained his mount which almost immediately veered inwards onto Mamma Sans. Mr Johnson was forced to take a hold of Mamma Sans which in turn hampered Saronic Miss with both runners being checked.

Mr Bourke stated it was Sulcifera’s first race day start and the first time he had ridden it. He was told prior to the race that the horse was green. Soon after the start it got its head in the air and when he attempted to straighten Sulcifera the horse shifted inwards sharply. He added he had never ridden a horse as green as that before. Mr Walsh stated that Mr Bourke should have stayed back a bit longer before shifting inwards. He was caught out by the greenness of Sulcifera which had over reacted when being restrained.

Submissions for Penalty:

Mr Davidson submitted the incident was at the low end of the scale. Mr Bourke had done his best with Sulcifera which had contributed through its racing greenness. Mr Bourke has had about 20 rides in his career to date but mainly on highweights and over hurdles. It was Mr Bourke’s first offence and he admitted the breach at the outset. He was seeking a suspension at the low end of the scale of two south island days.

Mr Walsh stated Mr Bourke had been caught out by Sulcifera’s racing manners. It was his first offence and had admitted the charge at the first opportunity. Any suspension beyond Riccarton on the 23rd September would be severe.

Reasons for Penalty:

Mr Bourke was riding Sulcifera for the first time. He was told the horse was race green and should have been more aware of what the horse might do during the running. Coming across the field from an outside gate at the start of the race, and at a sharp angle, is a difficult manoeuvre to perform with safety with an experienced horse, let alone a green one. Mr Bourke was clearly caught out by the horse’s abrupt inwards movement and interference to two other runners was a result. We see this breach as being a little higher up the scale than the low end, as was submitted by the stewards. Due to the interference a suspension is appropriate.
