As Mr Johnson admitted the breach it is found proved.

Penalty:

Mr Johnson is suspended from the conclusion of racing on 16 December up to and including 23 December 2018 (6 days). 

Facts:

Following the running of Race 10, the Mosgiel Tavern 1400, Stewards lodged an information alleging Mr C Johnson breached rule 638(1)(d) – careless riding- in that he “…permitted his mount Major Ish Choux to shift outwards passing the 250 metres causing Belle Hope (S Muniandy) to be checked.”

Rule 638 (1) (d) reads:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be

(d) careless.

Mr Johnson admitted the charge and appeared at the hearing.

Mr McLaughlin, with the aid of the video replays, stated MAJOR ISH CHOUX was trailing the leaders into the home straight. About the 300m mark Mr Johnson shifted outwards from his three out position to gain clear room and in doing so took BELLE HOPE’S line for two or three strides. Mr Muniandy was forced to take a hold and check back, losing ground and momentum. He said Mr Muniandy was entitled to his line. As a result of the interference two wider runners were also checked slightly.

Mr Johnson stated he was trailing VINO TINTO prior to his shifting outwards. He said as he shifted outwards VINO TINTO drifted outwards also, but by this point he was committed to the shift. He had not realised a horse (BELLE HOPE) had come up on his inside. He said Mr Muniandy was entitled to his clear run but believed VINO TINTO had contributed to the interference.

Submissions for Penalty:

 Mr Davidson said Mr Johnson had had five suspensions in the past 12 months, three of those in the past two months. He had been suspended for eight days (6th October), five days (5th November) and six days (24th November). He said the interference was low to mid-range and there was interference to other runners.

Mr Johnson stated he felt the interference was at the low end of the scale. While there was resultant minor interference to wider runners they had not been affected at the finish. He had between 8-10 rides per meeting and would prefer a suspension to start immediately.

Reasons for Penalty:

We take a starting point of 6 days suspension and increase that by 1 day for Mr Johnson’s poor record, to 7 days. We have taken into account that VINO TINTO shifted outwards and was a contributing factor in that Mr Johnson shifted wider than he initially intended in order to avoid the heels of that horse. While other runners were slightly affected we are not concerned with them as their finishing placings were not significantly affected. Mr Johnson has also admitted the breach.

In considering those factors we reduce the suspension to six days.
