As the respondent has admitted the breach, we find the breach proved.

Facts:
Mr Davidson alleged that with approximately 1150 metres to run Ms Williams (MOONLIGHTING) shifted ground inwards when insufficiently clear of SPLIT DECISION (L Callaway) causing that runner to clip a heel and blunder.
Submissions for Decision:
Mr Davidson demonstrated that some 300 metres after the start Ms Williams commenced an angled inwards run from the outside of the field. She could be seen to look three times to her inside but she kept coming across and eventually came into contact with Mr Callaway’s mount, which clipped a heel and blundered.
Ms Williams said she was concerned that Ms McKay was crowding runners on her inside at the front of the field and simply did not see Mr Callaway, who was racing slightly behind her, when she looked. She emphasised she was looking inwards and forward and had thus failed to appreciate Mr Callaway was being placed under pressure. She said he did not call out to her for room and Mr Davidson confirmed Mr Callaway had agreed when Mr Davidson questioned him that he had not done so, as something had stuck in his throat at the crucial time.
Submissions for Penalty:
Mr Davidson described the respondent’s record as very good. She had no breaches of the careless riding rule this season. He assessed the breach as mid to high range, as Mr Callaway’s mount was lucky to stay on its feet after it clipped heels and blundered.
Ms Williams confirmed she had no breaches of this rule this season and that she rode only in the South Island.
Reasons for Penalty:
We agree with the informant’s assessment of the breach as mid to high range. Ms Williams has moved into Mr Callaway’s line of running when insufficiently clear and has placed him in a very difficult position. A mitigating factor is that Ms Williams clearly did look inwards not once but 3 times and did not see Mr Callaway. We accept there was inwards movement near the front of the field and that that took her attention. Nonetheless, Mr Callaway was on the respondent’s immediate inside and Ms Williams should have been aware of this when making an inwards movement.
We are aware suspensions of 2 days have been imposed recently in the South Island for careless riding. However, these breaches were at the low end of the scale, and the jockeys had excellent records. Ms Williams qualifies on the latter but not the first count. From a 5-day starting point we give a 2 day discount for her excellent record and ready admission of the breach.
