DECISION AND REASONS:
--Stipendiary Steward, Mr S Ching alleged that with approximately 300 metres to race COUP CHRISTCHURCH ridden by Mr CW Johnson moved outwards when insufficiently clear causing PERNOTE (J Laking) to check. Mr Johnson admitted the offence.
--Video footage showed two riders going for one gap. The gap appeared to belong to Mr Laking but he was pushed sideways and had to ease. Miss Cameron's mount, No.6, THE HURRICANE, complicated the issue but she was within her rights.
--As Mr Johnson admits the breach we find the charge proved.
--Mr Ching indicated a fine was appropriate but it should be a substantial one ? say $1000. Mr Johnson had two previous careless riding charges upheld in the period since he resumed riding in September 2005. These were on 11 January 2006 at Reefton, a fine of $450, and on 23 January 2006 at Trentham, a suspension of 4 days.
--Mr Johnson was given credit for his guilty plea and the committee acknowledged the offence was at the lower end of the scale and that the Stipendiary Steward felt it was a result of competitive riding. Mr Johnson had no submission.
--However, the Committee felt that as it was his third offence in less than six months he has been back riding, they felt a combination of a suspension and a fine was appropriate. Mr Johnson was fined $500 and suspended for two riding days, being the 16th February and the 18th February 2006, resuming after racing concludes on The 18th February 2006. This period includes a premier day at New Plymouth.
