We find the charge proved.

Penalty:

Ms Rathbone is fined $150 and reminded of her obligations under the Rule.

Charge:

Mr Davidson alleged that Ms Rathbone used her whip excessively prior to the 200m mark on Lautenschlager.

Facts:

Mr Davidson demonstrated on the video that the respondent used the whip approximately 12 times running up to the 200m mark. It was the Steward's view that this was excessive use of the whip, was outside the whip guidelines and a clear breach of the Rule.

Submissions for Decision:

Ms Rathbone accepted the video evidence. She stated that Lautenschlager was a difficult horse to get going over the final stages. She also stated she was used to North Island tracks where there was a hurdle in the home straight but admitted it was an error on her part.

Reasons for Decision:

Ms Rathbone admitted the breach.

Submissions for Penalty:

Mr Davidson produced Ms Rathbone’s record, which was clear under this rule this season. He stated the degree of excessive use was out of character in his experience with Ms Rathbone and could not recall having spoken to her previously about the Rule. He submitted a penalty by way of a fine between $100 and $200 was appropriate.

Ms Rathbone accepted the submission on penalty made by Mr Davidson.

Reasons for Penalty:

We accept Mr Davidson’s description of the incident and the evidence of the video. Although the breach itself is towards the upper end we take into account the following: the respondent’s use of the whip was out of character for her, that her record under the Rule is excellent and her ready admission of the breach.
