The defendant has admitted the breach which we thus find proved.

Penalty:

Mr Webb is suspended from the end of racing on Tuesday 1st November up to and including Wednesday 9th November (2 days).

Charge:

Stipendiary Steward Mr Davidson alleged that Mr A Webb (Jaggard) had riden his horse carelessly at about the 300 metre mark causing interference to J Bullard (Ric O'Shea) when not sufficiently clear.

Facts:

Mr Davidson showed the Committee several video clips of the alleged incident. Stipendiary Steward Mr Ray also highlighted to the Committee Mr Webb's actions stating that he had made insufficient effort to stop his mount shifting out inside the 300 metre mark resulting in J Bullard (Ric O'Shea) being forced wider and having to be checked and lose running to which he was entitled.

Mr Webb stated that he had simply made an error of judgement on this occasion and had not reacted quickly enough to the incident.

Submissions for Penalty:

Mr Davidson stated that he believed the breach was at the mid range point of carelessness. Mr Davidson produced the defendant's record that showed he had no previous breaches under this rule in the previous twelve months and in fact had an outstanding riding record.

Mr Davidson also stated that Mr Webb was now riding principally in the South Island.

Mr Webb confirmed his riding was now done in the South Island.

Reasons for Penalty:

The Committee was satisfied a breach of rule 638(1)(d) had occurred and in our belief it was in the mid range of carelessness.

In this instance no horses chances were severely affected and they were not prevented of finishing in a dividend bearing place.

In fixing penalty the Committee gave credit to Mr Webb for his early admittance of the breach and also for his excellent riding record over the past twelve months.
