Mr Ching sought a ruling that GLADIATOR?S CHOICE be declared a late scratching in Race 7.
----Mr Ching demonstrated on the head on and side on videos that when the horses were released a starter's assistant was still holding on to the left rein of GLADIATOR?S CHOICE. Ms Pou the rider of the horse in question was also present and she confirmed that her horse was being held when the gates opened and that her arm struck the arm of the assistant as her horse attempted to move forward, which affected her balance.
----We are satisfied that GLADIATOR?S CHOICE lost several lengths at the start and it is clear on the videos that Ms Pou and the assistant's arm came into contact as the gates were opened. We also accept Ms Pou's evidence that the left rein of her horse was being held by the assistant as the horses were released.
----In these circumstances we accept Mr Ching's submission that GLADIATOR?S CHOICE was denied a fair start and declare the horse a late scratching.
