Mr Ching stated declarations closed at 10 am on Thursday 26 February but riders for SOPH D’OR and ANGE D’OR were not declared until about 11.13 am that day. Mrs Christophers had explained the declarations had not been made on time because she expected the race to be “split” and she was having difficulty engaging riders.

Mr Ching noted that Mrs Christophers might have been better advised to have notified him of these difficulties before the deadline. In respect of penalty, Mr Ching considered that there were mitigating factors in that Mrs Christophers was having the above-mentioned difficulties, had a good record of compliance with the rule, and that both horses were engaged in the same race. Mr Ching submitted that a total fine of $50 might therefore be appropriate, rather than the more usual $50 per horse.

After brief discussion, the panel imposed a fine of $50, noting the mitigating factors in this instance, particularly that both horses were in the same race. We remind Mrs Christophers of her obligations under the Rules of Racing.
