As Mr Papier has admitted the breach, it is found to be proved.

Mr Papier’s licence is suspended for 5 days. This is from the end of racing on 8 February up to and including 16 February 2020.
Facts:
Mr Davidson alleged that Mr Papier in race 7 permitted his mount TURNCOAT to shift inwards when not sufficiently clear of JOHNNY JONES which was dictated inwards onto XCUSES XCUSES which was checked near the 1000 metres.
Mr Oatham demonstrated that the respondent was 3 wide near the front of the field when he shifted inwards. He said Mr Papier was following Ms Williams across. She had room to shift but Mr Papier was never clear of the rider to his inside (Ms Comignaghi) when he commenced to shift. Mr Papier ended up racing in a 2-wide position.
Mr Pitman said Mr Papier was following Ms Williams across without realising there were two horses to his inside. He was coming in when he thought he was clear, but he obviously was not.
Submissions for Penalty:
Mr Davidson produced the respondent’s record. He said this was Mr Papier’s first day back after a two and a half year break from riding. He said the breach was low to mid-range.
Mr Pitman asked us to take into account the respondent’s record, his admission of the breach and that he had had a long break from riding.
Mr Papier sought a deferment of any suspension that we might impose until after racing on 8 February.

We believe that the breach is at the higher end of low range. Mr Papier has followed Ms Williams across and has not been aware there were 2 horses to his inside (JOHNNY JONES and XCUSES XCUSES), which were inconvenienced as a consequence. The obligation on Mr Papier is to be his length and another clear. He was not.
The starting point is 7 national days. Mr Papier had 30 rides prior to his break from riding. He had no breaches of the careless riding rule in that time. This is his first breach. A day’s credit is appropriate for this and a further day for his admission of the breach.
