The Committee therefore finds the charge proved.

Penalty:

Mr Chowdhoory is suspended from the end of racing on the 6th December up to and including the 17th December (8 days).

Facts:

Stewards charged Mr K Chowdhoory with careless riding – r 638 (1) (d) in that he caused interference to CELINE inside the final 150 metres. Mr Chowdhoory (RENOUNCE) did not admit the charge.

Submissions for Decision:

Mr Oatham outlined the incident with the use of the videos. He said RENOUNCE was two horse widths off the running rail about the 200 metres mark when leading the field. Mr Chowdhoory was seen to draw his whip and ride his mount out. In doing so RENOUNCE shifted outwards sharply and came into contact with CELINE on its outer. Mr Chowdhoory straightened his mount but allowed his horse to run outwards and hamper CELINE about the 100 metre mark. He said Mr Chowdhoory continued to use his whip throughout and made no attempt to straighten his mount either before or after it came into contact with CELINE. Mr Mudhoo was forced to take a hold and lost momentum.

Mr Mudhoo stated he was forced to take a hold of his mount when contact was made. He had to steady his horse, which didn’t run on due to losing momentum.

Mr Chowdhoory stated his horse was shying away from the big screen video and the corporate tents in the infield. He said most of the other runners were running away from them also. He did straighten his horse up once he came into contact with CELINE. Mr Pitman stated he believed RENOUNCE had shifted inwards and had contributed to the incident but did admit there was contact. He said the interference was low range.

In summary Mr Davidson stated Mr Chowdhoory was allowed to shift outwards, until contact and interference was made. Until then he had made no attempt to straighten his mount. Mr Mudhoo was forced to restrain his mount on both occasions.

Reasons for Decision:

Mr Chowdhoory’s mount RENOUNCE shifted outwards sharply about four to five horse widths wide from its two out running line. RENOUNCE came into contact with CELINE about the 150 metres mark and again at the 100 metres mark severely hampering that runner. Mr Chowdhoory had every opportunity to correct his mount prior to the first contact, but chose to ride his mount out instead.

Submissions for Penalty:

Mr Davidson said Mr Chowdhoory had had 420 rides in the past 12 months. He had one previous suspension in January of this year under the same rule. He sought a suspension in the mid-range of 8 days. Mr Chowdhoory said he was riding regularly in the North Island and requested a deferment until after Riccarton on the 6th December.

Reasons for Penalty:

Mr Chowdhoory chose to defend the charge, his record is very good but the level of carelessness is in the mid-range. A suspension in the mid-range is appropriate.
