DECISION & REASONS:
--Stipendiary Steward Mr N Goodwin, lodged an information alleging jockey Mr T Harris, the rider of JUNO, near the 1200m permitted his mount to shift in when insufficiently clear of SUMMER QUEEN (M Walker), which had to be checked and clipped the heels and lost running to which it was entitled.
--Mr Goodwin read the rule 871(1)(d). Mr Harris did not admit the breach.
--When questioned by Mr Goodwin, Mr Walker confirmed he received tightening from Mr Harris, having to take a hold of SUMMER QUEEN, then clipping the heels of JUNO as he moved across in front of him taking his line of running. In reply to Mr Herd, Mr Walker confirmed he did not call to Mr Harris.
--Mr Rae demonstrated on the films available Mr Harris allowing his mount to move across when not the required distance clear, taking the line of SUMMER QUEEN clipping that horses heels and checking that horse.
--Mr Herd agreed SUMMER QUEEN had clipped heels. He said, Mr Harris moved over when one and a half lengths clear, and Mr Walker's horse had not come back under a hold and Mr Walker could have called.
--The committee, after considering all the evidence, and having viewed the films, support the sipendiary steward's evidence that Mr Harris did cross over when not the required distance clear, resulting in Mr Walker's mount clipping the heels of JUNO and find the charge proven.
--Penalty:
--Mr Goodwin in presenting Mr Harris's record informed the committee of two previous charges of this rule, and said, this was not a case at the top end but warranted a suspension.
--Mr Herd, in submissions, appealed to the committee of the many rides and good record of Mr Harris, and that he does ride throughout the country.
--The committee has taken the submissions from both parties into account. Apprentice jockey Harris has erred in his judgement when crossing over and the degree of the interference. The committee find on this occasion a term of suspension is appropriate and Mr Harris is suspended from the close of racing on Wednesday 25 July 2007 up to and including the close of racing on Sunday 29 July 2007.
