We find the breach proved.

Penalty:

Having regard to the mitigating factors we’ve identified, we fine Mr Robinson the sum of $150 and remind him of his professional obligations.

Charge:

Mr Davidson alleged a breach of rule 638(3)(b) in that between the 400 and 200 metres mark Mr Robinson struck his horse COPPER TAP excessively.

Facts:

Mr Davidson demonstrated on the video that the respondent was in breach of the rule in that when he used the whip prior to the 200 metres, he failed to stop using the whip for 6 strides before using it again. 

Submissions for Decision:

Mr Davidson said there were at least 12 consecutive strikes with the whip, which was in breach of the RIU guideline.

Mr Robinson has accepted that his actions were outside the RIU guideline as to what constitutes excessive use of the whip. He said he was not hitting the horse each stride and that the horse was giving each time. He said he had failed to go back to his whip rein and had just “overdone it”.

Mr Robinson has admitted the breach.

Submissions for Penalty:

Mr Davidson has asked for a monetary penalty in the range of $100 to $200, and Mr Robinson agreed that this was appropriate.

We take into account Mr Robinson’s excellent record, this being the first time he has been charged with a breach of this rule in his many years of race riding, and his ready admission of the breach. We note the Penalty Guide indicates a starting point for a first breach of a fine of $300.
