----Mr Hughes in evidence said he felt Mr Bates had tried right to the line but his mare was stopping and the other horse was finishing well and had her measure from 200 metres out. He felt his horse was well tried and passed before Mr Bates stopped riding. He used the film to demonstrate his points.
----Mr Bates felt he had ridden her the same all the way up the straight. He felt the angle was different because of the placement of the camera. He also used the film.
----Mr Hunter said Mr Bates had dropped his hands a stride short of the line and put his hand back on the whip rein when he relaxed and gathered his horse up.
----We find that Mr Bates did relax a stride short of the line and did not meet the criteria of the rule. We therefore find the charge proven.
----Penalty:
----Mr Hunter asked for a suspension. He pointed out similarities to the JD Laking suspension at a recent Otago meeting. He felt both instances were very similar. Mr Bates preferred a fine to a suspension.
----Mr Hunter said Mr Bates had never offended against this rule before and had a completely clean riding record for the past 12 months.
----He said however he had affected the quinella and trifecta dividends and cost the owners stake money.
----Taking all the above into account we suspend Mr Bates' licence for the period of 4 weeks, up to and including 26 September 2004 and a fine of $250.
