CHARGES: Mr Davidson alleged that Mr Bothamley failed to make the weight on IAN CHARLES (race 1) and FLYING TUI (race 4). He was replaced on these 2 horses.

Mr Bothamley admitted the charge, which we thus find proved.

FACTS: Mr Davidson stated that immediately on arriving at the course Mr Bothamley indicated that he believed he would have difficulty riding IAN CHARLES (race 1) and FLYING TUI (race 4) at their carded weight of 57 kg. Replacement jockeys were able to be obtained for these 2 horses. On being questioned by the Committee, Mr Davidson said that these jockeys were of similar experience and ability to Mr Bothamley.

Mr Bothamley explained he had difficulty with his weight and had done his best to ride at 57 kg.

Mr Davidson confirmed that Mr Bothamley had ongoing weight issues and to his mind to Mr Bothamley was making every endeavour to keep his weight down. He was a regular user of the sauna.

REASONS: Mr Bothamley has one previous breach of this rule on 11 February last. He was fined $150 on that occasion. We agree with Mr Davidson that this can be regarded as a good record considering Mr Bothamley’s ongoing weight issues. We take into account that the connections of the horses and those who wished to invest on the horses were not disadvantaged to any large extent, in that riders of similar experience and ability to Mr Bothamley were obtained.

Taking into Mr Bothamley’s record and his ready and open admission of the breach, we believe the matter can again be dealt with by the way of a fine at the lower end of the range.
----
DECISION: Mr Bothamley is fined the sum of $150 and reminded of his obligations under the Rules of Racing.
