Under Rule 520 (4) (c) Stipendiary Steward Mr Ching alleged that “J Laking was unable to make the contract weight for YASEMIN in Race 1 and HONOUR THE CHEQUE in Race 2, being at least 1 kg over the carded weight. He was replaced in both races”.

Submissions as to penalty were heard. Mr Ching said Mr Laking approached the stewards before Race 1 saying he would be at least 1 kg over on both rides. He said Mr Laking has his problems and winter is the worst time. He is honest, but has an obligation to his owners and trainers. Mr Ching said as it is a while since he last failed to make the weight that he would be comfortable with a fine but felt it must be in the $500 to $700 range.

Mr Laking said he would prefer a fine as the Grand National meeting is coming up.

--Giving credit for his early guilty plea and his communication with the stewards, but reminding him that he has obligations to his owners and trainers, we fine Mr Laking $600.
