As Mr Prastiyou has admitted the breach, it is found to be proved.
Penalty:
There is no need to increase the 3-day South Island starting point, and we give a one day credit for the respondent’s very good riding record and his admission of the breach. The penalty is thus 2 days’ suspension: Ashburton on 24 July and Riccarton on 1 August. Mr Prastiyou is suspended from riding at the end of racing today up to and including 1 August.
Facts:
Mr J McLaughlin, stipendiary steward, alleged that near the 1200 metres in race 9 the CROMBIE & PRICE OAMARU CUP OPEN HANDICAP 1600 metres, Mr D Prastiyou, apprentice jockey, (ELECTRONIC MOTION) allowed his mount to shift in when not clear of SIR SINGO (Ms S Collett) causing that runner to be severely restrained.
Mr McLaughlin demonstrated on the head-on and side-on videos that Ms Collett was racing 2 out and the respondent has come from a 3 wide position and placed pressure upon her. He pointed out that Ms Collett’s horse had its head turned inwards and she has had to take a firm hold as a consequence of Mr Prastiyou’s actions. The respondent was not his length and another clear at the time he moved inwards.
Mr Prastiyou said he was coming across slowly and thought Ms Collett had plenty of room. There was no yelling that he could hear.
Mr Harnett, apprentice mentor, assisted the respondent, and said he had only come in gradually on entering the back straight. Ms Collett’s horse was on the bridle and was pulling a bit. He added there was “no heavy interference and it was not intentional, just a misjudgment”. He thought Ms Collett had over-reacted by standing up in the saddle.

Mr McLaughlin produced the respondent’s record was showed one suspension this season at Wingatui on 13 February, a Premier day, where the penalty was 4 days’ suspension. He believed the breach was mid range and that a 3 day suspension was appropriate.
Mr Harnett reiterated his belief the breach was low range and emphasised the respondent’s record was very good.
Reasons for Penalty:
It is our view the breach is at the very low end of mid-range. Ms Collett was severely inconvenienced by the respondent’s actions. It was fortunate that due to her being an experienced jockey, she was able to anticipate that Mr Prastiyou was going to continue his inwards movement and she took hold early, thus avoiding a greater degree of interference.
