Mr Salleh you have admitted a breach of rule 871(1)(d) in Race 6. Mr Ching has demonstrated on the videos that shortly after the start you allowed your mount TAWNCE to shift ground inwards when not sufficiently clear checking ASHBURY ELLEN (Mr Todd) onto REINBIRD (Mr Ichikawa) which was severely checked and nearly fell.

Mr Salleh we agree with Mr Ching that this incident of careless riding is towards the upper end of the scale. You severely checked 2 horses and it is fortunate that Mr Ichikawa and his mount were not put through the running rail. A starting point of 6 days is appropriate.

We give limited credit to your good record as you state you?ve only had 28 rides, but nonetheless, it is your first time in the room before a JCA panel. Although we note Mr Ching says he has spoken to you advisedly on more than one occasion.

We accept your statement, supported by Mr Kennedy, that the horse was racing erratically prior to your angled run across the field. The horse has clearly ducked out immediately prior to this. Nonetheless, your attempt to relieve the pressure on Mr Todd and Mr Ichikawa was not, as Mr Kennedy suggested, a stride too late, but was at least 2 or 3 strides too late. Giving credit also to your ready admission of the breach and taking into account your limited riding experience, we make a 2 day deduction from our starting point. You are suspended for one month from the end of racing today up to and including 18 July 2005. This is in effect 4 South Island racing days.
