Under Rule 871 (1) (d) Stipendiary Steward Mr S Ching alleged that Mr T Hazlett, the rider of number 4 TORRENT, allowed his mount to shift inwards after jumping the fence near the 1000 metres

Under Rule 871 (1) (d) Stipendiary Steward Mr S Ching alleged that Mr T Hazlett, the rider of number 4 TORRENT, allowed his mount to shift inwards after jumping the fence near the 1000 metres causing SUNKAI, ridden by C Levique, and STICKY FINGERS, ridden by C Johnson, to be checked and hampered.

Mr Davidson illustrated by way of video evidence that Mr Hazlett allowed his mount to roll in with resultant tightening, as described.

Mr Hazlett, while admitting the breach, noted that his horse had lost ground in bungling the previous fence, and as a natural pace setter tended to roll back to the fence. Mr Hazlett emphasised that he did not wish to deny his responsibility but that the incident was unintentional.

As the offence is admitted we find the charge proven.

Submissions as to penalty were then considered.

Mr Ching, in considering the level of offending to be mid range, sought a suspension or, having noted the shortage of jumps riders - a substantial fine.

--

Mr Hazlett requested a minimal suspension given his excellent record.

--

Mr Ching stated that Mr Hazlett has an exemplary race riding record with reference to the careless riding rule with no recorded breaches within the last 12 months. Indeed Mr Hazlett stated that he believed that it was some 3 years since he had breached the careless riding rule.

PENALTY

Taking all the above into account and the fact that Mr Hazlett is one of the country's busiest jumps riders attending meetings in both islands, we suspend his horseman's licence for two days, commencing at the conclusion of racing at Otaki on 18 August 2007 and concluding after racing finishes at Te Aroha on Thursday 23 August 2007.

We considered that a three day suspension may have been justified but taking all the matters into account we have concluded that a two day suspension was more appropriate. In particular we considered that credit be given for Mr Hazlett's "exemplary" riding record over the past three years (especially considering the number of jumps rides that he fulfills nationally).
