Mr Davidson, stipendiary steward, alleged that T and L Prendergast were in breach of rule 508(2) and (5) in that they failed to declare riders for ASHBURY ICE FLIGHT in race 7, THE MAD MARCH HARE in race 9 and CASHMAN in race 10. They admitted the breach and indicated they did not wish to be present at the hearing.

Mr Davidson explained that as is the usual practice the racing bureau had rung the trainers ½ an hour after declarations had closed. Mr Prendergast explained they had simply forgotten to notify the bureau, and riders names were given within 10 minutes.

The Prendergasts have a previous breach of this rule some 10 months ago. We are aware the “standard fee” is $50 per horse and this is the amount that Mr Davidson has recommended. We impose a fine of $50 per horse which amounts in total to $150.
