Facts:
Following the running of race # 1 the MAINSTAY BRYDONE HOTEL MAIDEN an information was filed by Mr J McLaughlin alleging J & K Parsons “...instead of presenting Alpine Julz for race one you presented El Jodi which was engaged in race three...”
Rule 404 (2) reads:
A person shall not enter, accept, start or intend to start a horse in a Race or trial (including a jump-out or test for certification purposes) under a name other than its registered name or its recorded breeding details in the case of an unnamed horse that it is entered for or starts in a trial.
Mr Parsons was present at the hearing and admitted the charge.
Mr McMcLaughlin stated that Mr Quirk, Stipendiary Steward on plating duties, inspected a horse presented for plating. He found the brand did not match the horse Alpine Julz. In fact the brand matched the horse El Jodi which was entered for race three.
Mr Parsons stated he boxed all his runners for the meeting in race order. He stated both Alpine Julz and El Jodi were similar looking horses and an error had been made when placing the wrong horses in wrong boxes. He said the error should not have happened and a mistake was made when saddling the wrong runner for the race.
Submissions for Penalty:
Mr McLaughlin stated the JCA Penalty Guide recommended a fine of $800. He stated Mr Parsons had no similar breaches under the Rules.
Mr Parsons stated it was a genuine error and should not have happened. He made no specific submissions on penalty.

Mr Parsons presented the wrong horse (El Jodi) to race in race one. Fortunately, on this occasion, the error was picked up during the plate inspection and the correct horse (Alpine Julz) took its place in the field.
Mr Parsons admitted the charge at the first opportunity and has an excellent record.
Mr McLaughlin asked for a penalty in the range of $800 and we take that as a starting point. We give Mr Parsons credit for his early admission and excellent record.
