Facts:

Mr Smith was charged with a breach of the Programming Conditions Regulations 15 (a) (i) in that he was late presenting his runner in the stabling area.

Regulation: 15 Race meeting Attendance:

(a) The trainer of any horse engaged in any race at a totalisator race meeting shall  ensure that such horse is available with an attendant in the official stabling complex (or in its allocated stall).

(i) at least one hour prior to the advertised starting time of the first race of the meeting where it is entered in that race, or if entered in a subsequent race at least ninety minutes prior to the advertised start time of the race.

Mr Smith admitted the charge and did not attend the hearing.

Mr Renault stated that Mr Smith’s horse was not in the stabling area at the correct time prior to race three. He said Mr Smith should have been on course by 12.17pm, but did not arrive until 12.57pm. He said Mr Smith, when spoken too by Stewards, admitted he was late. He stated he had miscalculated the travel time from his Canterbury stables to the course.

Mr Renault stated that he was surprised this breach was not on the Minor Infringement Notice list, hence the charge being by way of an Information. He said it was a simple case of Mr Smith making an error over travel time. He sought a fine of $100. Mr Smith had a good record with no previous charges in the past 12 months for a similar offence.

Mr Smith is charged with a minor breach of a Regulation. Taking into account his good record and early guilty plea a fine at the low end of the scale is appropriate.
