Decision:

As Mr Campbell has admitted the breach, it is found to be proved.

Penalty:

Mr Campbell is fined the sum of $200 and is reminded of his obligations under the Rules of Harness Racing.

Facts:

Following the running of race 5 the Stipendiary Steward, Mr Renault, filed an information alleging Junior Horseman, Mr Campbell, moved ground outwards when not entitled to do so and in so doing forced BELMONT JET (Ms Purvis) wider on the track.

Rule 869(4) and (6)(b) and (c) read:
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse and its progress.
(6)(b) a horse making a forward movement during any race shall not be forced to race wider on the track.
(6)(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.

Mr Renault stated that Mr Campbell (NO MORE CHANGE) was on the pole line positioned towards the rear of the field as it neared the 1000 metres mark. Ms Purvis was racing last and to his outside. She had progressed forward on to his wheel when the respondent shifted out and moved her wider on the track. Mr Renault said the respondent had just shifted out too soon. Had he waited another 50 metres, he would have been able to shift out in accordance with the rules.

Mr Campbell said he was aware he was following poorly performing horses and he was trying to get out, as he did want to run into “a brick wall”. He had thought he was within the final 1000 metres and had simply miscalculated.

Mr Cox said it was just a slight error of judgment by the respondent in his eagerness to get out.

Submissions for Penalty:

Mr Renault produced Mr Campbell’s record. He had had 35 drives last season and 36 the season before. His record was clear under this rule. Mr Renault stated the starting point in the JCA Penalty Guide was a $250 fine or a 5-drive suspension.

Mr Renault said Mr Campbell had received a position in the race to which he was not entitled. He submitted a fine of $200 was appropriate.

Mr Campbell asked that he be fined rather than suspended.

Reasons for Penalty:

Mr Campbell has shifted Mr Purvis wider on the track in contravention of the push out rule. Ms Purvis was forced to race wider on the track for a time.

The respondent has an excellent record under this rule and has admitted the breach. He is a junior driver. A starting point of $250 is appropriate and the mitigating factors warrant a $50 reduction to the sum of $200.
