Mr Curtain had pleaded guilty and elected not to attend the hearing. Under Rule 1111 (1) (d) I find the charge proven.

Submissions as to penalty from Mr McIntyre were that Mr Curtin has an excellent driving record - from 214 drives this season he has never been before a judicial committee and has no previous charges upheld under this rule for the past year. Mr McIntyre said a standard fine for this offence without previous offending is about $200. I fine Mr Curtin $200 - and in doing so give credit for his record and ready admission of the charge.
