Stipendiary Steward Mr N G McIntyre alleged that horseman Mr D Moore used his whip excessively in the run home whilst driving RUSHIN COURAGE. Mr Moore admitted the offence and video evidence confirmed this. As Mr Moore has admitted the offence under Rule 1111 (1) (d) I find the charge proven.

Submissions as to penalty were heard with Mr Moore stating a preference for a suspension.

Mr McIntyre indicated a suspension of 2 days was appropriate. I agree with this and Mr Moore had indicated his next two race days were to have been Ashburton and followed by Waikouaiti on 17 February.

I suspend Mr Moore's licence up to and including 17 February 2008 and have taken into account his ready admission and give credit for his good driving record.
