After viewing the video evidence and as Mr Crawford admits the charge, under Rule 1111 (1) (d0 I find the charge proved.

Submissions as to penalty were heard. Mr Crawford said he did not hit the horse at all till the 300 metres and that his horse kept running home under a strong drive. This compared with the horse's earlier effort when it went roughly.

Mr McIntyre said the horse had been hit 22 times in the run home, which is too much. He said Mr Crawford is an experienced driver who does not drive all that often. He has a clear record and asked for a fine of $200, which is normal for a first offence.

Mr Crawford thought about half that amount.

I take into account Mr Crawford's ready admission and his clear record but find that 22 strokes of the whip in the straight could be termed excessive and fine him $200.
