Following Race 2 Stipendiary Steward Mr McIntyre alleged that "C J Harvey as the driver of GUADELOUPE used his whip excessively in the run home".

Following Race 2 Stipendiary Steward Mr McIntyre alleged that "C J Harvey as the driver of GUADELOUPE used his whip excessively in the run home".
--He stated that excessive means too much – number of times. He said video evidence showed Mr Harvey used the whip in excess of 30 times from the top of the straight. Mr Renault counted 33 times.
--Mr Harvey said he hadn't hit the horse but mainly the shaft and merely tapped the horse itself 3 or 4 times.
--Before giving the decision we pointed out to Mr Harvey that excessive use applies whether striking the horse, harness or sulky. It relates to the number of times hit – not the amount of force.
--DECISION:
--We find the charge proved – that is, that you used your whip over 30 times from the top of the straight. In doing this we concede the strikes were generally on the sulky and were not hard.
--SUBMISSIONS as to penalty were heard. Mr McIntyre said Mr Harvey is a first offender and said the normal penalty would be $200 fine or a two-day suspension. Mr Harvey said he preferred the suspension.
--DECISION: Taking into account Mr Harvey is a first time offender we suspend his horseman's licence for two days commencing today and including Forbury Park TC on 7 May and up to and including Timaru HRC at Timaru on 10 May 2009.
