Mrs Williams alledged that "with approximately 1400 metres to run M Purdon (Becker) moved Rocky Mountaineer (K Baron) from three wide to four wide-a breach of the pushout rule."
| -- DECISION & REASON --Mrs Williams alledged that "with approximately 1400 metres to run M Purdon (Becker) moved Rocky Mountaineer (K Baron) from three wide to four wide-a breach of the pushout rule." Mrs Williams claimed that Rocky Mountaineers' progress was impeded by being forced over extra ground, caused by the whole movement of Mr Purdon's horse. She alleged Mr Baron could not pull back because of the speed his horse was travelling. Mr Larkin (Stipendary Steward) used video to illustrate the events that occurred --Mr Baron in evidence, said he went to make ground around the field but the field changed and he had to go wider. He started three wide and ended four wide. The horse inside had come out and rather than check his horse he went out. It was Mr Purdon's horse. He agreed he had a choice to go on or pull back. If he had done neither, he would have struck a wheel. --Mr Purdon said he felt Mr Baron had a choice and he had decided to press on. He felt even if he (Mr Purdon) had moved earlier, Mr Baron would still have pressed on. Mr Purdon felt the horse in front of him was "not that good" so he decided to come out. --DECISION --We are of the opinion that Mr Baron's evidence was inconclusive but the video evidence clearly showed that Mr Baron was forced four wide and it had occurred in contravention of rule 569 (6) (b) and (c)-particularly 6b, therefore we find the breach proven. --PENALTY --Submissions as to penalty were taken, Mrs Williams asked for $250 and Mr Purdon $200. Taking everything into account, we fine Mr Purdon $200. |
