Mrs Williams asserted that PF Kerr was back off the mobile gate at dispatch thereby failing to maintain his position.

Video evidence was shown which confirmed the allegation. As Mr Kerr admits the breach I find that under Rule 1111 (1)(d) the charge is proven.

Submissions as to penalty were heard, Mrs Williams asked for a $200 fine and as Mr Kerr was not present I concur with Mrs Williams and fine Mr Kerr $200.
