--This is a protest by Mr Escott, Chief Stipendiary Steward, against the 1st placing of WADDELL in Race 1 on the grounds that after 400 metres the horse shifted outwards forcing TAKE THE CASH wider on the track.
--| -- This is a protest by Mr Escott, Chief Stipendiary Steward, against the 1st placing of WADDELL in Race 1 on the grounds that after 400 metres the horse shifted outwards forcing TAKE THE CASH wider on the track. Judge's placings were: 3, 15, 14, 4, 8, 13. ----Mr Escott called Mr Forbes, driver of TAKE THE CASH, who stated that some 400 metres after the start Mr MacDonald came off the fence pushing him wider on the track and that he was checked. He said eventually the hind legs of TAKE THE CASH came into contact with the wheels of Mr MacDonald's sulky and as a consequence TAKE THE CASH broke and lost some 30 to 40 metres. Mr Young, driver of TRIPLE X who was following Mr Forbes, said that Mr MacDonald came out and pushed Mr Forbes 3 wide and "things got tight". Mr MacDonald continued to move out and made contact with TAKE THE CASH. Mr McIntyre, stipendiary steward, demonstrated on the video that Mr Forbes was pushed wider and that TAKE THE CASH broke after the move was completed. He said that while Mr MacDonald was not hard up on the fence he was following the leading horse before he moved to the one out position to follow Mr Williamson. Mr MacDonald said that he was always 2 out and that he was simply moving forward to follow Mr Williamson. ----We prefer the evidence of Mr Forbes, Mr Young and Mr McIntyre. While the video is not entirely conclusive of whether Mr MacDonald was hard up on the fence, he was clearly following the leading horse before he moved to the one out position to follow Mr Williamson. In these circumstances we find that Mr MacDonald has moved out in contravention of Rule 869(8)(b) and that he has forced Mr Forbes wider on the track. He has eventually come into contact with the legs of TAKE THE CASH with the result that that horse broke losing 30 to 40 metres. We thus find the interference to TAKE THE CASH was caused by the outwards movement of Mr MacDonald. The progress or chance of TAKE THE CASH was clearly interfered with by Mr MacDonald and we exercise our discretion and relegate WADDELL to behind TAKE THE CASH. ----Amended placings are: 15, 14, 4, 8, 3,13. ------ Chairman -- |
