Mr Dunn admitted the breach, which we thus find proved.  

Penalty:

We impose a fine of $200 and ask Mr Wallis to remind Mr Dunn of his professional obligations. 

Charge:

Mr Wallis alleged that the respondent, Mr J Dunn, used his whip excessively when driving PIPER HEIDSIECK out in the run home. 

Facts:

Mr Wallis demonstrated the breach on the video. This showed that Mr Dunn commenced to use the whip as the horses entered the home straight. Mr Wallis said he believed there were 22 strikes in total, with the quick fire nature of the strikes in the last 100 metres being of particular concern. 

Submissions for Penalty:

Mr Wallis stated he believed the breach was towards the bottom of the range. He produced the respondent’s record, which showed a breach of the rule in January of this year. On that occasion Mr Dunn was fined the sum of $200. Mr Wallis stated he believed a similar fine was appropriate on this occasion as the respondent had some 350 to 400 drives in this time and had not breached the rule again. 

Reasons for Penalty:

We view the breach as being towards the bottom of the range. We counted 21/22 strikes in the straight, with some respite, and, like the stipendiary steward, we are concerned at the repetitive nature of the strikes in the last 100 metres. We accept this was at a time PIPER HEIDSIECK was fighting out a stirring finish and that the horse just went under but this is no excuse for a breach of the rule.

From a starting point of $400, a discount is appropriate for Mr Dunn’s ready admission of the breach and his good record under this rule. He certainly appears to have heeded the warning given to him in January.
