We find that TOWNEY has failed promptly to regain its gait and exercise our discretion and disqualify that horse from 4th placing.
Amended placings are:
1st 12 MASTA TODDY
2nd 2 BETTOR AWAY
3rd 10 PRINCETON
4th 3 CRAFTY KNIGHT
5th 5 TANGO LADY
 

Facts:

Ms Williams, stipendiary steward, alleged that TOWNEY over the concluding stages broke in excess of 50 metres.
Judge’s placings were:
1st 12 MASTA TODDY
2nd 2 BETTOR AWAY
3rd 10 PRINCETON
4th 16 TOWNEY
5th 3 CRAFTY KNIGHT
The margins were a neck, ½ L, ½ head and a nose.

Ms Williams had Mr Renault, stipendiary steward, demonstrate that TOWNEY galloped some 80 to 90 metres from the winning post. The horse galloped across the line.
Mr D Johnston, the trainer of TOWNEY, indicated he did not contest the protest.
 

Reasons for Decision:

We are satisfied that TOWNEY galloped for at least 80 metres immediately prior to the winning post. This is clearly in excess of 50 metres over the final 200 metres and is contrary to the passing lane regulations.
