Mr Faulkes admitted the breach which we thus find proved.

We impose a fine of $200 and remind him of his professional obligations.

Charge:

Ms Williams, stipendiary steward, alleged that with 1100 metres to run Mr A Faulkes (LIFES DECISION) drove carelessly when crossing SAMARIAS BROMAC resulting in that horse being checked.

Facts:

Ms Williams demonstrated on the videos that when the defendant was moving forward 3 wide he shifted in when not sufficiently clear causing interference to SAMARIAS BROMAC, which was 2 wide, and the following horse, ARNOUX. She said there was contact with SAMARIAS BROMAC. Both SAMARIAS BROMAC and ARNOUX broke for a stride but the defendant’s actions did not affect the chances of either horse.

Mr Faulkes indicated he did not wish to be present at the hearing.

Submissions for Penalty:

Ms Williams produced the defendant’s record, which was clear. She said the breach was low end and submitted a fine of $200 was appropriate.

Reasons for Penalty:

We agree with Ms Williams that the breach is at the bottom of the range of careless driving. The defendant’s record is excellent with respect to this rule and he has admitted the breach.
