Miss Cox admitted the charge and it is found proved. 

Penalty:

Taking these mitigating factors into account, especially the fact that this is Miss Cox’s first breach relating to the manner of her driving, she is fined the sum of $150. 

Facts:

Following the running of Race 7, the SOUTHERN WINES MOBILE PACE an information was filed by Stipendiary Steward Mr N Ydgren, against Junior Horsewoman Miss K Cox, alleging a breach of Rule 869 (3) (b) in that... K Cox (Match Point) drove carelessly with approximately 500m to race when attempting to shift wider on the track when not entitled to resulting in her horse breaking.

Miss Cox was present at the hearing and admitted the breach. She was assisted by Mr Butt.

Rule 869 (3) (b) provides:

No horseman in any race shall drive 

carelessly

Submissions for Decision:

Mr Ydgren demonstrated on the video the relevant positions of the horses as they raced down the back straight towards the final bend. Miss Cox (MATCH POINT) was racing four back on the marker peg line on the inside of PROVEN R (S Stewart). He showed where Miss Cox pushed PROVEN R wider on the track. As they approached the 500m mark Miss Cox attempted to push PROVEN R wider again. However, he stated Miss Cox did not have an advantage over PROVEN R on its outer and as a result her horse struck the inside sulky wheel of PROVEN R and broke losing its chances. No other horses were involved in the incident.

Mr Butt agreed with the evidence given by the Stewards. He stated Miss Cox had gone too far in trying to push the outside horse wider. It was a mistake on her part.

Submissions for Penalty:

Mr Quirk stated Miss Cox had admitted the breach at the earliest opportunity. Her record was excellent and she had not been charged with a similar offence. She had had approx. 200 drives with about 70 of those this season. The breach was at the lower end of the scale and he sought a fine of $200.

Miss Cox stated she was paying off a student loan. She was able to pay a fine as she was a busy Junior driver. She had admitted the breach and it was her first driving offence. 

Reasons for Penalty:

The breach is at the bottom end of the scale. The only horse affected by the respondent’s carelessness is her own. Miss Cox admitted the charge at the first opportunity and her record is excellent. She is also extremely remorseful.
