--| -- DECISION AND REASON ----A request for a ruling was filed under Rule 213(j), which states ?a horse denied a fair start and such occurrence materially prejudiced the chances of that horse.? ----No.6, MELISSAWAY, fell in the run-up. The point of start for the race had been reached but the starter still had the arms of the starting gate extended and the green light had not been activated. He could not recall whether he had called ?Right? or not. Mr McClelland, the driver of MELISSAWAY, could not recall hearing this either. ----Following the fall of the horse the starter pulled away and turned on the green lights. ----The Chairman found that MELISSAWAY was on the ground when the dispatch was made and should be declared a late scratching as the starter had not dispatched the field at the point of dispatch and MELISSAWAY had fallen before the dispatch was made. |
