Decision:

The committee has discretion under the Rule and in this instance the Committee exercises that discretion. The Protest is dismissed and the placings as called by the official judge stand. 

Facts:

Following the running of Race 1, the MONARCHY TROT, an Information instigating a protest was filed by Stipendiary Steward Mr N Ydgren, alleging that Father Christmas shifted outwards at the start and checked Cameron Castleton which lost its chances.

The Judge's placings in this race were as follows:

1st    FATHER CHRISTMAS (1)
13th CAMERON CASTLETON (2)

Rule 869(8) provides as follows:

The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or

(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Submissions for Decision:

Mr Ydgren, using the head on and side on videos, stated that shortly after the start Father Christmas broke from its gait, ran outwards and struck the inside sulky wheel of Cameron Castleton. He said that at the time contact was made Cameron Castleton was not in its correct gait. Despite this he believed Cameron Castleton was hampered and unable to regain its correct gait quickly losing considerable ground and its chances.

Mr Dunn stated Cameron Castleton broke at the start on its own accord and was in a break when the interference occurred. He was of the opinion that Cameron Castleton never trotted sufficiently well during the running, breaking on four occasions, and that the interference at the start did not affect the horse's chances.

Mr Brad Williamson stated that Cameron Castleton was already in a break when his horse ran outwards striking its sulky wheel. Mr Phil Williamson agreed with the evidence of his driver and Mr Dunn.

In his closing summary Mr Ydgren did not dispute the evidence given by either driver.

Reasons for Decision:

The video evidence shows both runners were in a break of their own accord shortly after the start. After approx. 20 metres Father Christmas ran outwards striking the inside sulky wheel of Cameron Castleton. At the point of this interference Cameron Castleton, while being restrained by Mr Dunn, was not in its correct gait. As a result of the interference both horses lost considerable ground. Mr Dunn also stated the interference had made no difference to the horse’s performance from that point. Mr Ydgren did not dispute the evidence of either driver.

The committee has to consider whether the interference by Father Christmas was sufficient enough to deny Cameron Castleton a chance of finishing in a better position, despite Cameron Castleton being in a break at the time the interference occurred.

Taking into account the video and verbal evidence the committee finds that the chances of Cameron Castleton were not affected sufficiently enough to warrant a change of placings.
