Decision:

Mr Thomas, who was assisted by Mr D Butcher, licensed horseman, admitted the charge, which we thus find proved.

Penalty:

We also give credit for his ready admission of the breach, and believe a fine of $150 is sufficient to hold Mr Thomas accountable. He is reminded of his obligations under the Rules of Harness Racing.

 

Charge:

Mr Ydgren alleged that Mr Thomas driving DUBLIN BOY in Race 10 shifted MAGICAL MEL and GIPSY JAKE wider on the track with 1200 metres to run in breach of the push out rule.

Facts:

Mr Ydgren had Mr Renault, stipendiary steward, demonstrate the breach on the video. This evidenced the fact that Mr Thomas had moved off the fence pushing Mr Orange 3 wide and Mr O’Reilly 4 wide. These actions were in breach of rules 869(4) (6)(b) and (c).

Submissions for Penalty:

Mr Ydgren submitted that the Penalty Guide suggested a penalty of $250 and/or a suspension of 1 week. He stated that as Mr Thomas had admitted the breach and had no previous breaches of the rule, he believed a penalty of $200 was appropriate on this occasion.

Mr Thomas did not disagree with Mr Ydgren's submission and asked us to take into account that this was his first breach of the rules.

Reasons for Penalty:

This is a breach of the push out rule, which has resulted in 2 horses racing wider on the track. There are no aggravating factors. Mr Thomas’s record is clear. This is the first time he has been before a judicial committee. Mr Thomas is contrite and admits he made an error of judgment. We believe he will learn from his experience of being ‘in the room’.
