Rule 870(5) is clear.  If the horse was lapped on when it galloped across the line it "shall" be relegated to behind any horse that is lapped on.  TRADE ME NOW was lapped on by WAIHEMO ANGUS.  It is therefore relegated to behind that horse.

Amended placings are:

1st - 6 THE BLACK FOREST

2nd - 3 BERT POWELL

3rd - 1 ALWAYS TREASURE

4th - 10 WAIHEMO ANGUS

5th - 7 TRADE ME NOW

Dividends and stakes are to be paid accordingly. 

 

Facts:

This was a protest by Mr Wallis against horse number 7, TRADE ME NOW on the ground that the horse was lapped on by horse number 10, WAIHEMO ANGUS, when it galloped across the finishing line. 

Judges placings were:

1st - 6 THE BLACK FOREST

2nd - 3 BERT POWELL

3rd - 1 ALWAYS TREASURE

4th - 7 TRADE ME NOW

5th - 10 WAIHEMO ANGUS

The margin between 4th and 5th was a neck.

Submissions for Decision:

Mr Wallis had Mr Renault demonstrate on the video that some 40 metres before the finish TRADE ME NOW, which had been 5 or 6 back and was progessing one out from the rail, broke free of interference and galloped across the line.

Mr Versteeg, the driver of TRADE ME NOW, indicated that he represented the connections and did not contest that TRADE ME NOW should be relegated to behind WAIHEMO ANGUS.

Reasons for Decision:

We have viewed the incident on the video and we are satisfied that TRADE ME NOW broke free of interference and galloped across the line.  WAIHEMO ANGUS was lapped on to TRADE ME NOW at the time.  There was only a neck between TRADE ME NOW and WAIHEMO ANGUS, which finished 5th.
