Charge:
Mr Renault alleged that Mr Todd, driving ANVIL GAV in race 5, the PG Wrightson Mobile Pace, came up to the start out of position, resulting in a false start being declared.
Mr Todd indicated to Mr Renault that he did not require the assistance of a senior horseman, and indicated on the information that he admitted the breach and did not wish to appear.
Facts:
Mr Renault demonstrated on the video that the respondent was slow to come into position on the front line. He explained that Mr Todd had stated that ANVIL GAV was a difficult horse to drive and he had elected to follow up Ms Young, who had drawn barrier 6. Unfortunately, he came into position outside Ms Young rather than to her inner, where there was a clear space for him. This resulted in a false start being declared.
Submissions for Penalty:
Mr Renault produced the respondent’s record, which was clear under this rule. He stated that having regard to the Mr Todd’s record, his admission of the breach and the fact that he was a junior driver, a fine of $200 was appropriate.
Reasons for Penalty:
We agree that Mr Renault has identified relevant mitigating factors to which we would add the manners of ANVIL GAV. This issue also arose at an earlier hearing with respect to the horse being presented late on the track. We accept he is an exceptionally difficult horse to drive.
We believe a fine of $150 is sufficient to hold Mr Todd accountable.
