In these circumstances we rule that FREEFALL has been denied a fair start. Mr Renault may thus rule that FREEFALL is a late scratching.
Facts:
Mr Renault, stipendiary steward, sought a ruling after the running of race 3, the Golden Girls Greater Canty Series Mares Mobile Trot, as whether FREEFALL had been denied a fair start after QUEEN MARY broke.
Rule 213(1)(j) provides:
213(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds: …
(j) if a horse was denied a fair start.
Submissions for Decision:
Mr Renault demonstrated on the video that QUEEN MARY, Mr McCormack, which had drawn 1 on the front line broke some 20 metres before the start. The horse continued in a gallop to the start but kept its position on the front line at that time. FREEFALL, which had drawn 1 on the second line, was immediately behind QUEEN MARY. He said the issue for the committee was whether FREEFALL had been inconvenienced before, at, or after the start.
Mr Lamb, the official starter, gave evidence that he was aware that QUEEN MARY was in a gallop before the start but at the time he was satisfied that the horse was holding its position and that FREEFALL had not been affected. He said everything had happened very close to the start and he had made the call not to declare a false start. He said on viewing the video he was still of the view QUEEN MARY had kept her position on the front line, but he could now see that Mr Borcoskie was having to take a hold of his horse.
Mr Borcoskie, the driver of FREEFALL, gave evidence that he had had to ease his horse back before the start when QUEEN MARY galloped some 20 metres before the start. He said he had to move wider on the track to progress past the galloping QUEEN MARY. He estimated that he had lost some 5 lengths as a consequence. He said his progress had been clearly affected.
Mr Renault in reply said after repeatedly viewing the video he was satisfied that Mr Borcoskie was correct when he said he had had to ease before the start.
Reasons for Decision:
Having heard from the parties and also viewing the video a number of times, we accept Mr Borcoskie is correct when he says he had to take hold of FREEFALL to avoid the galloping QUEEN MARY and that this action was before the start of the race. Mr Borcoskie’s estimate of having lost 5 lengths is confirmed by the video.
