Facts:

Following race # 7 the PGG WRIGHTSON HANNON MEMORIAL PACE the Stewards lodged an information under Rule 869 (4) alleging that Ms Ottley (PURE POWER) caused interference to PASS THEM BY.  The information alleged that “…you allowed your horse PURE POWER to shift up the track and failed to take sufficient corrective measures to ensure PASS THEM BY was not interfered with.”

Rule 869 (4) states:

No horseman shall during any race do anything that interferes or is likely to interfere with his own horse or its progress.

Regulation # 7 of the PASSING LANE, FALSE RAILS AND HOME STRAIGHT REGULATIONS states:

Except where a horseman is making a mover pursuant to Rule 869 (7) and subject to the preceding provisions of this regulation where applicable, every horse shall upon entering the home straight prior to the finish maintain as straight a course as possible to the finish line.

Miss Ottley admitted the charge and attended the hearing.

Mr Renault asked the evidence submitted at the previous Protest into this race be taken into account. He further stated that Ms Ottley, when allowing her horse to drift outwards, continued to use the whip and did not straighten her horse until about the final 100m. Up until the final 100m she had allowed her horse to drift 3-4 sulky widths. She had options but had failed to take them.

Miss Ottley stated that PURE POWER had resisted the boring pole and had run out when she had used the whip. She had not realised she had drifted that much until she straightened up prior to the finish line.

Submissions for Penalty:

Mr Renault stated Ms Ottley was in her first season as a licensed open horsewoman. She has had 31 drives this season. Last season she had 535 drives. She has two previous charges of Rule 869 (3) (b) – (careless driving) at Methven on the 23rd March this year ($300) and the 29th November last year ($200).

Mr Renault submitted the starting point for a Gp III race is a fine of $750 or 15 drives. He said there were aggravating factors involved with this charge, a change of placings in a Gp III race and two previous charges under Rule 869 (3) (b). He was seeking either a suspension or a fine.

Miss Ottley stated it was her first charge under this Rule 869 (4). She had a good record considering the number of drives she had had in the past 12 months. It was a Gp III race not Gp I race. She preferred a fine.

Reasons for Penalty:

The committee has taken into account Ms Ottley’s early admission of the breach, her cooperation with the Stewards, her good driving record and that she is clearly remorseful. The aggravating factors are that this is a Gp III race and a change of placings resulted. It is also Ms Ottley’s third breach of a driving rule inside 12 months.

We have taken a starting point of $750. Miss Ottley is given credit of $200 for her early admission of the breach. She is given a further $100 credit for her good driving record.
