Mr Butt admitted a breach of rules 869(4) & (6)(b)(c) in that he forced HEART SPACE (N McGrath) wider on the track with approximately 1800 metres to run.

Mr Renault, assistant stipendiary steward, demonstrated the incident on the videos. This showed that Mr McGrath was making swift progress on the outside of MALOSI when Mr Butt came out forcing HEART SPACE to race 4 wide for some 200 metres.

Mr Butt stated he had simply got caught out by the speed with which Mr McGrath was moving up on his outside.

Ms Williams asked for a fine of $200, while Mr Butt suggested that as he had a good record under the rule, the fine should only be $150.

Mr Butt is a senior horseman. He has no breaches of this rule this season, and I accept for some 2 or 3 seasons prior to this, as stated by Mr Butt. However, there is nothing unusual in this particular breach. Mr Butt has been deceived by the speed with which Mr McGrath improving on his outside and the consequence was that Mr McGrath was left without cover. In these circumstances I agree with Ms Williams that a fine of $200 is appropriate and that is the amount that is imposed.
