This was an information filed by Ms Williams, stipendiary steward, alleging that the shoes on DUSTIN BROMAC were in poor repair and had to be removed prior to the start.

--

Ms Williams produced the shoes, which were worn. She added they were in poor repair and could have come off at any time and injured someone. She said Mr Dalgety’s record was excellent with respect to this rule and that his gear was generally in “brilliant condition”.

--

Mr D Dunn represented Mr Dalgety and admitted the breach on his behalf.  He explained that the horse paced better with worn shoes. He accepted, however, that they were in poor repair on this occasion. He said he had drawn this fact to the attention of the starter. He emphasised that the start of the race had not been delayed because of the incident.

--

The penalty guide recommends a fine of $175. Having record to Mr Dalgety’s excellent record and the ready admission of the breach, we believe the matter can be dealt with by a fine at this level. Mr Dalgety is thus fined the sum of $175.
