Mr R Holmes was charged with a breach of careless driving in Race 10. Stewards alleged that Mr Holmes allowed his horse Starkers to strike the wheel of Tad Lincoln near the 400 metres and was in breach of r 869(3)(b). Mr Holmes admitted the charge and appeared at the hearing.
Mr Renault stated that approaching the 400 metres mark Starkers was in the one-out one-back position. Mr Holmes angled out to challenge and in doing so Starkers struck the sulky wheel of Tad Lincoln. Mr Morrison looked down at his sulky wheel when contact was made. Tad Lincoln’s sulky tyre came adrift and the tube wrapped around the sulky axle.
Mr Holmes stated that it was raining at the time and driving conditions were very difficult. He had simply misjudged his outwards movement slightly.

Ms Haley stated Mr Holmes has an excellent record and was a very experienced horseman. He had no charges under the Rule in the past 12 months. Stewards sought the minimum penalty of a fine of $300.
Mr Holmes stated he would prefer a fine as opposed to a suspension.
