| -- DECISION AND REASONS: --Stipendiary Steward, Mr S Larkins, alleged that Mr D McCormick drove BLESS YOUR HEART in a manner likely to diminish its chances to win. He said and backed this up with video film, that Mr McCormick's horse missed away and was back a considerable distance. He tacked on to the field after 550 to 600 metres but did not slot in but continued in a three wide position and did not give his horse a breather. He was still three wide and now outside the leader with a lap to go being tapped up. With 750 to run the horse began to tire and finished 25.6 lengths from the winner. --Mr McCormick said that after galloping at the start, he came round the stables bend and intended to go up the inside but the horse ahead was moving about and he thought Mr Cameron's horse had tangled and decided to avoid any skirmishing by going out. He then had a choice to sit back or go on and chose the latter. "I still beat 5 or 6 home." The mare had run well at the trials, for a second last week in a good time. --Mr Larkins said the video evidence does not show Mr Cameron's horse in a break and even if it had, there was sufficient space for Mr McCormick to slot in behind Mr Williamson's horse in the one out line. --Decision: --The charge was found proven. --Submissions as to Penalty: --Mr Larkins felt it was a serious offence and asked for a six week suspension. --Mr McCormick disagreed. --Decision: --Taking Mr McCormick's clean record into account and the fact that it appeared to be an error of judgement, Mr McCormick's licence was suspended up to and including the 20th of March 2005, effectively for Mr McCormick, the two days of the Greymouth meeting. |
