Evidence:
Mr Wallis had Mr Renault point out the runners involved. He demonstrated, on the back straight camera at the 1700 metres, SOCIAL MEDIA, driven by Miss O’Reilly, racing towards the rear where she was on the 3-wide line, with MAKE UP ARTIST, driven by Mr May, inside her in the 2-wide line. Inside MAKE UP ARTIST (RT May) was BENZ BUY (Miss C Purvis). SOCIAL MEDIA (Miss O’Reilly) tries to improve downwards from the three wide to the two-wide line. In doing so she checked MAKE UP ARTIST (RT May) who then breaks for a short period. This causes Mr May to inconvenience two runners behind him.
Miss O’Reilly made no submissions.
Decision:
Miss O’Reilly admitted the breach so was found to be proved.
Submissions for Penalty:
Mr Wallis said that Miss O’Reilly is in her first season as a Junior Driver. Prior to today, she had driven in 32 races and had a clear record under the Rule. Mr Wallis said that the JCA penalty guide recommended a 10-day suspension or $500 fine as a starting point. He said that the interference was in the mid to low range. He believed that with an excellent record and admission of the breach that the stewards would be seeking a penalty of $350.
Mr O’Reilly said on behalf of Miss O’Reilly that it was her first breach of any rule, that she was a junior driver still learning and that MAKE UP ARTIST (Mr May) had not helped the situation.
Reasons for Penalty
In determining penalty, the Committee took the starting point for a breach of the Rule of a $500 fine. An aggravating factor was the fact that Miss O’Reilly had moved inwards causing another horse to break MAKE UP ARTIST (R May). Although only for a few strides. We did not believe it was serious enough to warrant and uplift in penalty. In mitigation Miss O’Reilly is a junior driver with not a lot of experience. She was honest with stewards and admitted the breach at the first opportunity. We also took into account her very good record. We therefore give Miss O’Reilly a $200 discount and fine her $300.
Penalty
Miss O’Reilly is fined the sum of $300.
