Facts:

Mr R Allen was charged with a breach of 869 (2) (a), excessive use of the whip, following his drive on DUSKY EYRE in race 9 the Springbank Handicap Trot. Stewards alleged Mr Allen “used his whip outside clause (b) of the Use of the Whip Regulations.”

Rule 869 (2) reads: No horseman shall during any race:

(a)    use his whip in an unnecessary, excessive or improper manner.

The Whip Guidelines read:

(b)    No horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Allen did not admit the breach and attended the hearing.

Submissions for Decision:

Mr Renault, with the aid of the videos, stated Mr Allen used his whip on 15 occasions from the top of the straight to the finish line. He said while he had the whip and rein in one hand he struck the horse with a striking motion more than was permitted under the Guidelines.

Mr Allen stated he did not believe he had breached the rule. He had kept the whip in his rein hand and did not believe they were strikes with the whip.

Reasons for Decision:

Mr Allen struck his horse 15 times with the whip inside the final 400 metres. While he held the whip and rein in one hand they were clearly strikes on the horse. 

Submissions for Penalty:

Mr Renault stated Mr Allen had a clear record and did not drive a lot. He said the JCA Penalty Guide recommended a starting point of $300 for using a whip 15 times.

Mr Allen did not make any penalty submission.
