Facts:
Following the running of Race 7, Dakins Group (Free-for-All) Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr SP Renault, against RONALD J (SL Whatuira), placed 1st by the judge, on the ground that it “broke in excess of 50 metres inside the final 200 metres”.
Miss SL Whatuira, driver of RONALD J, had endorsed on the information form and signed “I do not wish to be present at the hearing of this information” and, further, “I do not contest the protest”.
The official placings for the race were:

Rule 870 provides as follows:
(3) Any horse which breaks from its gait shall promptly regain its proper gait.
The Breaking Horses Regulation provides as follows:
For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:
(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.
Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:
(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or
(ii) disqualify it from the race under Rule 1003 (2).
Submissions for Decision:
Mr Renault showed a video replay of the final 200-300 metres of the race. He pointed out RONALD J, driven by Miss Whatuira, improving through the middle of runners as the field approached the 200 metres, before switching to the inside. Mr Renault pointed out a marker on the inside of the track, marking the point 100 metres from the finishing line. Shortly after passing that marker, RONALD J went into a gallop, free of interference, and continued on in a gallop past the finishing line, finishing in 1st placing, the winning margin being a head. Mr Renault submitted that the horse had galloped for a distance of approximately 90 metres. He sought disqualification of RONALD J.
Reasons for Decision:
The Committee was satisfied that RONALD J had broken from its gait, free of interference, approximately 90 metres from the finish and had continued on in a gallop past the finishing line and being first across the line. The Committee was clearly satisfied that RONALD J had galloped for a distance well in excess of 50 metres and had, therefore, failed to promptly regain its proper gait in breach of Rule 870 (3) and the Breaking Horses Regulation
The Committee also noted that Miss Whatuira did not contest the disqualification of RONALD J.
